This Privacy Notice explains the treatment of your information when you access or use the Nifty Humals video game (the “Game”) owned and offered by Defend Nature Interactive, Inc. (“DNI” or “we”) and your options related to your privacy. This Privacy Notice is governed by the Nifty Humals Terms of Use, and we encourage you to read it carefully. Capitalized terms not defined in this Privacy Notice have the meaning given in the Terms of Use. DNI may provide additional notices about our privacy practices, each of which will be considered part of this Privacy Notice. Please note that this Privacy Notice does not apply to any websites or platforms not owned or operated by DNI, including games or features provided by third parties through DNI offerings.

By accessing or using the Game in any manner, you consent to the collection and use of your information as described in this Privacy Notice. If you do not agree with this Privacy Notice, do not access or use the Game.

1. Definition: Personal Data

When we say “Personal Data,” we mean any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. Personal Data includes:

• Identifiers (e.g., name, email, telephone number, address, username)
• Sensitive information (e.g., government ID, health data, precise geolocation)
• Legally protected information (e.g., race, citizenship, marital status, sex)
• Employment-related information
• Non-public educational information

Not all information about you is Personal Data. This may include publicly available information, aggregated information (data summaries with Personal Data removed), and anonymized information that cannot be linked back to an individual.

2. A Note About Children’s Privacy

The Game is available to registered players (“Player” or “Players”) aged 16 and older. DNI does not knowingly collect any Personal Data from Minors without obtaining consent from the Minor’s Guardian. If you are a Minor and wish to play the Game, please ask your Guardian for permission and help registering an account.

CHILDREN UNDER AGE 16 ARE STRICTLY PROHIBITED FROM PLAYING THE GAME.

Minors should always check with a Guardian before sharing information online, and we encourage families to discuss guidelines regarding the online sharing of Personal Data. Guardians are solely responsible for monitoring their child’s account and gameplay.

If we become aware that a Minor has registered under an inaccurate age or that a Minor has provided us with Personal Data without Guardian consent, we will delete any Personal Data we have collected, unless we have a legal obligation to keep it, and terminate the Minor’s account. If you become aware of any unauthorized submission of information to DNI, please submit a Privacy Request or contact us by email at humals@defendnature.com.

3. Personal Data Collected and Its Use

The Game is designed to collect minimal Personal Data from Players, as detailed in this section. Where Personal Data is collected, DNI does so as reasonable and necessary and only with your consent, with a legitimate interest, or as authorized or required by law. The Game collects identifiers, internet or similar activity, and commercial history.

• Player Account Registration: When you register and create an account, the Game collects your email address, and you will select a username and password. You have the option to include other identifiers in your Player profile like your age, gender, and country location, or you may choose to provide us with commercial and other information about yourself such as your interests and preferences. DNI collects this information with your consent when you register and uses it to authenticate your account, facilitate your gameplay, and communicate with you.
• Communications from Players: If you contact DNI through our Discord channel, request support, provide feedback or complete a survey, DNI will collect your identifiers and any Personal Data you include in those messages. DNI collects this information with your consent and uses it to respond to your inquiry, provide you with support, and communicate with you.
• Payments Processed in the Game: If you purchase a subscription or merchandise or make in-game purchases, DNI does not collect or maintain any payment information. All payment transactions on the Game are processed by a PCI-compliant payment processor. DNI may collect commercial history data for our legitimate interest in facilitating your transaction and offering you customer support.
• Gameplay and Use of DNI Contents: When you play the Game, DNI may use cookies from Playfab or Unity to collect technical data about your account, Game progress, and content interactions. DNI collects this information for our legitimate interest in understanding and improving the Player experience.

4. Personal Data Disclosures

DNI only discloses Personal Data collected through the Game with your permission or as described in this section:

• Disclosures to DNI Service Providers: DNI relies on third-party service providers to provide and maintain the Game. Our service providers are subject to contractual agreements that protect your Personal Data.
• Third-Party Features: The Game may contain third-party features like social media interaction tools or in-game advertising. You should carefully review the third party’s privacy policy and terms of use.
• Our Affiliates: We may disclose the Personal Data we collect to our affiliates or subsidiaries, subject to this Privacy Notice.
• Law Enforcement: DNI may disclose Personal Data to law enforcement or other governmental agencies as permitted or required by law.
• Aggregated and Deidentified Information: DNI reserves the right to share aggregated, anonymized, or de-identified information with nonaffiliated entities for marketing, advertising, research, or other purposes.

5. Personal Data Retention

DNI retains Personal Data collected through the Game for the minimum period necessary to achieve the purpose of its collection. When we no longer have a business need for your Personal Data, we will delete, de-identify, or anonymize it.

6. Player Controls

• Player Account: Players can sign into their account to update their profile, download Personal Data, or delete their account.
• Device Settings: You can control data collection through cookies and related technologies by adjusting device settings.
• Emails: Players can unsubscribe from future emails by clicking the Unsubscribe link or contacting us.

7. The Game is Owned and Operated in the United States

The Game is owned and operated in the United States and primarily designed for Players in the United States and Canada. By allowing us to collect Personal Data, you consent to the transfer and processing of your Personal Data.

8. Data Security

The Game is designed with reasonable security measures to secure Player Personal Data. Please bear in mind that submitting data online is never entirely secure.

Depending on where you live, your rights over your Personal Data may include some or all of the following:

The Game may include links to third-party websites or services. DNI is not responsible for the privacy practices of Third-Party Services.

This Privacy Notice may be updated from time to time at DNI’s discretion. Your access to or use of the Game following an update is your acceptance of those changes.
